Terms of use
Last updated:
Provider and scope
- Forever Guides (this website) is run by Daniel Girster, address in the legal notice (“we”).
- These terms apply to the use of the website, in particular your account and every feature you use to post or share content. The community guidelines are part of these terms. How we handle personal data is described in the privacy policy.
- Forever Guides is an unofficial fan project and is not affiliated with Blizzard Entertainment.
Our service
- Reading needs no account. You need an account for personal features such as calendars and event sign-ups, character import, the collection album, clip submissions, guild listings, your own talent setups, macros, location screenshots for the location guessing game, the streamer directory listing, the author application and the supporter badge. Not every feature is available to everyone at all times.
- Use is free of charge. You make payments only with third parties (for example a Twitch subscription on Twitch), never with us. There is no right to particular features, constant availability or freedom from errors. We may change, pause or discontinue features. If we discontinue a feature in which you stored content, we will let you know beforehand where possible.
- We compile game data (talents, items, instances, routes etc.) with care and without guarantee. The game changes constantly. More on trademarks, sources and licences is on the page Copyright, trademarks and sources.
Your account
- You must be at least 16 years old to create an account.
- Sign-in runs through our self-hosted login system, with email and password or with your Google or Twitch account. Signing up creates a free user agreement between you and us under these terms.
- Keep your credentials secret and do not share your account. Tell us if you notice misuse. Accounts with extended rights may require two-factor sign-in.
- Your display name is public wherever you post content or sign up for events.
- Linked accounts (Battle.net, Google, Twitch) are optional; the providers’ own terms apply to their services. You can unlink them in your account.
Your content
- “Content” is everything you post here: clip links with title and description, guild listings, calendars, events and notes, sign-ups with character and role, talent setups, macros, location screenshots, guest guides, applications and your display name.
- You keep your rights. You grant us a simple, free, worldwide right to store, display, technically adapt (e.g. format and size) and make your content publicly available on this website as far as the feature intends. The right ends when you delete the content or your account, except for backups until they are overwritten as scheduled and content that remains under paragraph 5.
- You confirm that you hold the necessary rights and that your content infringes no third-party rights (copyright, trademark, personality rights) and no laws. For clips additionally: you own the clip, or its creators and any recognisable people agree to its publication here. For clips we only store the link; the video stays on YouTube, Twitch or Instagram.
- There is no right to publication. Our team reviews clips and guild listings before publication. We may reject content that breaks these terms, the community guidelines or the law, or that is off-topic.
- If you delete your account, we remove your content as described in the privacy policy. Published talent setups, guides and posts remain without your name; we delete them on request.
- For guides and posts you write as an accepted author, you additionally allow us to edit them (e.g. spelling, shortening, updates after game changes) and to keep them published, also after your author role ends.
Specific features
- Calendars and events: whoever creates a calendar or event (“organiser”) decides who can see it and is responsible for its content and organisation. When you sign up, everyone who can see the event sees your character (name, realm, class, level, faction) and role. Share calendar and event passwords only with intended participants. We do not organise the events and are not liable for them.
- Characters: sign up only with characters you own. Characters imported via the addon are not verified by Blizzard.
- Polls: one vote per person and poll. Voting multiple times, e.g. by deleting cookies or using bots, is not allowed.
- Supporter badge: it shows support for Wosande’s Twitch channel. We award it as a thank you, with no legal entitlement and no consideration owed. It gives no advantage for content or features.
- Macros: you can save macros privately. Only unlocked authors may make them public. Macros are aids for the game. Check yourself whether a macro is allowed under Blizzard’s rules; we give no guarantee for its effect in the game.
- Location guessing game: the submission terms apply to submitted screenshots. The leaderboard shows you only if you switch it on. Manipulating the scoring (scripts, bots, evaluating other people’s solutions) is not allowed.
- Streamer directory: the notes on the streamer application apply.
Submission terms for the location guessing game (location screenshots)
- Who may submit. You need an account and must be at least 16 years old. These terms of use and the community guidelines apply.
- Your own captures. You submit only screenshots you took yourself in the game. The “Forever Guides” addon records place and time for this. You do not submit other people’s images.
- No data of other people. Do not send images showing character names, name plates, chat windows, guild names or other personal details. Crop first or choose another image. We reject such images.
- Game art. The images show game art by Blizzard Entertainment. The rights in it remain with Blizzard. You grant us rights only in your own contribution (choosing and capturing the image), as far as any arise.
- Rights you grant us. A simple (non-exclusive), free, worldwide right to store and reproduce the image on this website, adapt it technically (resize, crop, convert) and make it publicly available in the “Ortsraten” game. The right has no time limit as long as the image is not deleted. We do not show your name with the image. There is no payment. We do not use the image for advertising and do not pass it on to third parties.
- Review. Our team reviews every image before release. There is no entitlement to publication. We reject images that breach these terms, the community guidelines or the law, are duplicates or do not fit.
- Deleting and withdrawal. You can delete your own submissions at any time under “My submissions”. We then stop showing them and delete the file. If you delete your account, we delete all your submissions. Rounds already played remain without the image. Your withdrawal takes effect for the future.
- Rejected images. Only you and our team see rejected submissions. We delete them on request or with your account.
- Reporting. Anyone can report a puzzle image with “Report”. We review the report and remove the image if it breaches these terms.
- Liability for your images. You assure us that you hold the rights and that no third-party rights are infringed. If an image breaches this, we remove it. We do not demand an indemnity.
- Privacy. What data we store is described in the privacy policy.
- Changes. If we change the consent text, we ask you again at your next submission. Earlier submissions remain under the text you agreed to at the time.
Notes on the streamer application and streamer directory
- Free and voluntary. Listing costs nothing. There is no entitlement to admission or placement.
- Your channel. You submit only channels that belong to you or that you may represent. Streamers of all games are welcome. We reject channels with illegal content or breaches of the community guidelines.
- Review. Our team reviews the application and may reject it. We reply to the contact email address.
- What becomes public. Name, platform, channel link, short introduction, live status, stream title, viewer count, and profile and preview image. We load images and stream details from Twitch through our server; your browser does not connect to Twitch for this. The rights in images and stream titles remain with you or with Twitch. You allow us to show them in this directory.
- Partner badge. Our team may give individual channels a partner badge. It is an editorial choice with no legal entitlement. If a badge involves consideration, we label it “Werbung” (advertisement).
- Removal. You can ask us at any time to remove your profile (email contact@forever-guides.com or contact form). We remove it promptly.
- Independent of Twitch. Forever Guides is not affiliated with Twitch Interactive, Inc. Twitch’s terms apply to your channel.
- Privacy. What data we store is described in the privacy policy.
Community guidelines
The community guidelines are on a page of their own and form part of these terms. They apply to everything you make visible here.
Reports and moderation
- Anyone can report content they consider illegal or against the rules: clips, guides, news, guild listings, talent setups, public macros and location images via “Report” on the content (also without an account), any other content (for example events and calendars) by email to contact@forever-guides.com (subject “Report”). A report should contain the link, a reason, your name and email address and a statement that your information is accurate to the best of your knowledge. If you give an email address, we confirm receipt and tell you the outcome.
- You can send us bugs, ideas and praise via “Feedback / report a bug” (footer or help button). This is not a report in the sense of this section: please report illegal content as described above.
- We review reports promptly, diligently and objectively. Decisions on user content are made by people, not automated systems. Only technical safeguards such as limits on too many requests work automatically.
- Possible measures, depending on severity: a notice, editing, hiding or removing content, restricting features, suspending or deleting the account. We consider severity, frequency and intent as well as the fundamental rights of everyone involved, in particular freedom of expression.
- If we restrict your content or account, we tell you by email what is affected, which rule or law we rely on, the facts behind it and how to appeal. We may skip this for obvious bulk spam. As a rule we warn you first before a restriction for repeated, obviously illegal content or repeated unfounded reports.
- Appeal: email contact@forever-guides.com (subject “Appeal”) within six months. We review the decision again and reply with reasons. Your right to go to court is unaffected.
- If we learn of a criminal offence threatening anyone’s life or safety, we inform the competent authorities.
- Single point of contact for authorities and users: contact@forever-guides.com (German or English).
Term, termination and deletion
- The user agreement runs for an indefinite period.
- You can end it at any time by deleting your account under Account → “Delete account” or by asking us. What is deleted is listed in the privacy policy.
- We may terminate with two weeks’ notice in text form, e.g. if we shut the website down. The right to terminate without notice for good cause remains, in particular for serious or repeated breaches of these terms.
Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
- For slight negligence we are liable only for breach of an obligation that makes proper use possible in the first place and on which you may rely, and only for foreseeable, typical damage. Otherwise liability for slight negligence is excluded.
- Other users and linked sites are responsible for their own content. We act as soon as we learn of illegal content.
Changes to these terms
We change these terms only when new features, changed laws or case law require it. We announce changes at least four weeks in advance on the website and, where possible, by email. Changes that materially restrict your rights apply only with your consent; without it, the previous terms continue to apply until you or we end the agreement.
Final provisions
- German law applies. If you are a consumer habitually resident in another EU country, the mandatory consumer protection rules of that country remain unaffected.
- If a provision is invalid, the rest remains valid and the statutory rules apply instead.
- The German version is binding; this English version is a translation for information.
